HIDDEL is a framework and language allowing health information providers and third-parties to describe health resources in a standardized and machine-processable way, and is a de-facto standard to (self-)disclose or to make (third party-) statements about important quality-related properties on a health website.

HIDDEL has been developed by the MedCERTAIN and MedCIRCLE consortia, which make the HIDDEL language and ontology available to you to use under the following licence agreement terms and conditions ('Open Vocabulary Licence').

In short, this licence allows anybody to use the HIDDEL language freely, as long as the sources are acknowledged and requests for changes or expansions are fed back to the community via the HIDDEL website and the HIDDEL Steering Group. HIDDEL licencees have the right to nominate, be elected to and elect members of the Steering Group.

1. Basic licence.   You are granted a non-exclusive, royalty-free licence to use, reproduce, and create derivative works from, and distribute the vocabulary and your derivative works thereof, subject to all of the terms and conditions of this Open Vocabulary Licence. If you use the vocabulary to publish XML/RDF/HIDDEL statements on the web you may not modify the language e.g. by using unauthorized values for the elements, without prior request to and authorization by the HIDDEL Steering Group. You may authorize others to exercise the foregoing rights; provided, however, that you must have an agreement with your sublicencees that passes on the requirements and obligations of this licence agreement and which must include a limitation of liability provision no less protective than Section 6 below.

2. Attribution Requirement.   As a material condition of this Open Vocabulary licence, you must provide the below applicable attribution statements on (1) all copies of the Open Vocabulary, in whole or in part, and derivative works thereof which are either distributed (internally or otherwise) or published (made available on the Internet and/or internally over any internal network/intranet or otherwise), whether distributed or published electronically, on hard copy media or by any other means, and (2) on any products, program, or web sites making use of the information contained within the Open Vocabulary, in whole or in part, or any derivative work thereof:

a) If the Open Vocabulary in whole or in part, or any derivative work thereof, is made available via the Internet or internal network/intranet and/or information contained therein is directly accessed or linked via the Internet or internal network/intranet then you must provide the appropriate attribution statement as described in the page(s) at the URL(s): http://www.hiddel.org/attribution.htm and provide a link to this URL.

b) If the Open Vocabulary in whole or in part, or any derivative work thereof, is made available on any hard copy media (e.g., CD-ROM, diskette), you must place on the packaging a notice providing credits as described in the page(s) at the URL(s): http://www.hiddel.org/attribution.htm . If there is no 'packaging', the previous attribution notice should be placed conspicuously such that it would be reasonably viewed by the recipient of the Open Vocabulary.

c) If you are using or distributing the Open Vocabulary in modified form (i.e., with additions or deletions), you must include a statement indicating you have made modifications to it. Such statement should be placed with the attribution notices required by Sections 2(a) and 2(b) above.

3. Right To Identify licencee.

a) You agree that MedCIRCLE has the right to publicly identify you as a user/licencee of the Open Vocabulary. Further, users of HIDDEL are collectively referred to as the "MedCIRCLE Collaboration". The "MedCIRCLE Collaboration" is a wider collaboration of health gateways, portals, accreditors, and health websites which use HIDDEL to enhance transparency, accountability, and quality of health information on the web. You agree that MedCIRCLE has the right to publicly identify you as a member of the MedCIRCLE Collaboration.

b) You are aware of the fact and agree that by publishing metadata on the web using HIDDEL your metadata may be harvested by search engines including the MedCIRCLE harvester, which compiles HIDDEL metadata in an Open Metadata Directory (OMD). This OMD in turn can be freely used by anybody under the terms and conditions published in the Open Metadata Directory Licence (see www.medcircle.org/licences/omd.htm).

c) Changes and amendsments. You agree that if you need to change or expand HIDDEL you will report you changes and expansions to the Steering Group. You are not permitted to use a changed version of the vocabulary on the web (e.g. publishing RDF statements with new "invented" values for elements with a controlled range of values) unless the change request has been approved by the Steering Group.

4. Errors and Changes.   From time to time the Steering Group may elect to post on the page(s) at the URL http://www.hiddel.org/attribution.htm certain specific changes to the Open Vocabulary and/or above attribution statements, which changes may be to correct errors and/or remove content alleged to be improperly in the Open Vocabulary. So long as you are exercising the licence to Open Vocabulary hereunder, you agree to use commercially reasonable efforts to check the page(s) at the URL http://www.hiddel.org/attribution.htm from time to time, and to use commercially reasonable efforts to make the changes/corrections/deletion of content from the Open Vocabulary and/or attribution statements as may be indicated at such URL. Any changes to the Open Vocabulary content posted at the page(s) at the URL http://www.hiddel.org/attribution.htm are part of Open Vocabulary.

5. No Warranty/Use At Your Risk.   THE OPEN VOCABULARY WITH THE REQUIRED ATTRIBUTION STATEMENTS ARE MADE AVAILABLE UNDER THIS OPEN VOCABULARY LICENCE AT NO CHARGE. ACCORDINGLY, THE OPEN VOCABULARY ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, INCLUDING WITHOUT LIMITATION THE WARRANTIES THAT THEY ARE MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING. YOU ARE SOLELY RESPONSIBLE FOR YOUR USE, DISTRIBUTION, MODIFICATION, REPRODUCTION AND PUBLICATION OF THE OPEN VOCABULARY AND ANY DERIVATIVE WORKS THEREOF BY YOU AND ANY OF YOUR SUBLICENSEES (COLLECTIVELY, 'YOUR OPEN VOCABULARY USE'). THE ENTIRE RISK AS TO YOUR OPEN VOCABULARY USE IS BORNE BY YOU. YOU AGREE TO INDEMNIFY AND HOLD MEDCIRCLE AND THE CONTRIBUTORS TO THE OPEN VOCABULARY HARMLESS FROM ANY CLAIMS ARISING FROM OR RELATING TO YOUR OPEN VOCABULARY USE.

6. Limitation of Liability.   IN NO EVENT SHALL MEDCIRCLE, ITS SUBSIDIARIES OR AFFILIATES, OR THE OPEN VOCABULARY CONTRIBUTING EDITORS, BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, AND REGARDLESS OF WHETHER ANY CLAIM IS BASED UPON ANY CONTRACT, TORT OR OTHER LEGAL OR EQUITABLE THEORY, RELATING OR ARISING FROM THE OPEN VOCABULARY, YOUR OPEN VOCABULARY USE OR THIS OPEN VOCABULARY LICENCE AGREEMENT.
